Ex-undersecretary challenges acceptance of conditional VRS application in Karnataka HC

BENGALURU: GK Purushothama, an ex-serviceman, who served as an undersecretary to State Election Commission has moved the Karnataka high court, challenging the decision of the authorities to accept his conditional application for voluntary retirement and relieving him from service.
A division bench headed by Justice AS Bopanna has ordered notice to chief secretary and the DPAR secretary in response to a petition.
Purushothama has challenged the April 27, 2017 order of the Karnataka State Administrative Tribunal in dismissing his plea.
Purushothama, an ex-serviceman, was discharged from military service on medical grounds as he suffered from disability. He later joined government service. According to him, while being on special duty in the Legislative Council during July 2003, he had a fall in the morning in Vidhana Soudha toilet at about 10.30 am, as a result of which, his right shoulder was dislocated and he was unable to move his right hand.
Later, he underwent surgery in the year 2004 and the same aggravated during the year 2006. In 2014, a medical board issued a certificate that he was suffering from diabetes mellitus type-II with liver cirrhosis with recurrent dislocating right shoulder.
After this, he submitted representation for either keeping him under supernumerary post as per section 47 of Persons with Disabilities Act, 1995 or grant voluntary retirement on medical grounds as per section 285 (2) of Karnataka Civil Services rules. He added that even though he had withdrawn the offer of VRS, the authorities accepted the same and relieved him from service.
