Mall in trouble as town planner finds violations

The newly-operational Ardee City Mall and multiplex, spread over 5.1 acres in Sector 52, is under the scanner of the department of town and country planning (DTCP) for violation of its approved building plan and unauthorised construction.

GURUGRAM: The newly-operational Ardee City Mall and multiplex, spread over 5.1 acres in Sector 52, is under the scanner of the department of town and country planning (DTCP) for violation of its approved building plan and unauthorised construction.
The senior town planner (STP) of Gurugram has recommended the cancellation of the occupation certificate (OC) of the mall to the director of DTCP following a complaint filed at the CM’s Window.
If this happens, this will be first time the OC of such a big and operational commercial building is cancelled in Gurugram. The developer did not respond to calls and messages from this correspondent.
In April 2017, Delhi resident Reena Joon had filed a complaint highlighting illegal construction in the mall. In her complaint, Joon said she had bought a shop on the ground floor of the mall. “My shop was on upper ground floor, but the developer (Ardee) made changes in the building after getting OC and now my shop is on the first floor,” she alleged.
Taking cognisance of the complaint, the DTCP director had directed the Gurugram STP to submit a report after investigating the allegations. STP Sudhir Chouhan, DTP (planning) RS Batth and DTP (enforcement) Ved Prakash Shehrawat inspected the mall and submitted their report last week. It highlighted that several violations of building plan were found at the mall and recommended that the OC be cancelled till the developer restores the mall as per the approved building plan. Till the unauthorised construction was removed, the report recommended sealing the mall.
“During the inspection, we found several violations. We’ve sent our report to the DTCP director with the recommended for cancellation of OC of the mall and multiplex. The no-objection certificate (NOC) of multiplex has been revoked. The director will take the final call on the issue,” Chouhan said.
During the inspection, it was found that no approval had been granted for the construction of a multiplex on the third floor of the mall in the original building plan. According to the report, Ardee has violated the approved building plan and made illegal and unauthorised construction — a store room in the lower basement and a fan room and store room in the upper basement. Moreover, changes had been made in the plan on the lower ground, upper ground, ground, first and second floors.
The report further mentioned that the developer is still making additional construction and is a continuous offender by neither abiding by the rules of the department nor maintaining the sanctity of the approved building plan.
The mall’s building plan was approved in 2012, and it became functional a few months ago.
